<p>Marion County Deputies pulled over a driver Sunday, March 7, 2010 after they witnessed the driver of the vehicle speeding and weaving in and out of traffic with his son in the car.  Deputies report that Anthony Earl Siple&#8217;s Honda Sunday night on suspicion of drunken driving.  Marion County deputies report that Mr. Siple  and followed him at 70 mph in a 55 mph zone for more than a mile with her lights on before he pulled over.</p>
<p>In the vehicle with Mr. Siple was his 12 year old son in the passenger seat.  According to deputies, Siple had a smell of alcohol and red and watery eyes.  Siple failed the walk and turn, one-leg stand and finger to the nose field sobriety tests, the deputy said. During the alphabet test, the man stopped at the letter &#8220;H.&#8221; </p>
<p>Siple was arrested on charges of driving under the influence and child abuse and neglect and was taken to the Marion County Jail, where a breathalyzer revealed Siple&#8217;s blood-alcohol content to be .292, deputies said. The boy was released to a relative could not finish, the deputy said.</p>

			<content:encoded><![CDATA[<p>University of Central Florida police arrested a driver accused of being intoxicated on campus Sunday.  UCF police allege the driver had more than 70 pills of controlled muscle relaxants in his car.</p>
<p>UCF police arrested Thomas Clyde Mastin Jr., 34, of Orlando, on allegation s of DUI.  According to UCF police, Mastin  admitted to the officer that he  had oxycodone, carisoprodol and alprazolam — three powerful muscle relaxants — in his car because he had &#8220;2 dislocated discs in his back,&#8221; the arrest report shows.  The police reports also shows Mastin explained he was on his way home after having &#8220;just a little bit&#8221; of alcohol at his mother&#8217;s bar in Casselberry where he works as a bartender.</p>
<p>Police found multiple prescription bottles for the medications under his name littering the vehicle. They also recovered a bottle of a prescription in another person’s name. All the pills had been mixed and divided among the different prescription bottles, police said.</p>
<p>Mastin  faces multiple counts of possession of carisoprodol, possession of controlled substance in unapproved manner, sale or delivery of oxycodone, possession of alprazolam with intent to sell, unlawful possession of a prescription, trafficking in oxycodone and driving under the influence and is being held at the Orange County Jail on a bond of $57,200.</p>
<p>Reports show police found his car parked in a grassy area on the side of Gemini Boulevard at about 6:21 a.m. Mastin was sleeping in the driver&#8217;s seat and appeared intoxicated, according to the arresting officer&#8217;s report.</p>
<p>Mastin failed the sobriety tests; however, a breath test measured his blood-alcohol content at 0.000. He told police he had a little alcohol before he left his mother&#8217;s bar, but also said he had taken some oxycodone before he started working.</p>

			<content:encoded><![CDATA[<p>Winter Springs Police stopped a marked city of Windermere patrol car shortly before 5:00 a.m. Thursday morning for suspicion of DUI.   According to agency reports, Officer Kristie Fink, a reserve officer still in training with the city of Windermere, was spotted by a Winter Springs officer driving a silver Windermere police vehicle on Winter Springs Boulevard and followed it after seeing it turn abruptly into the George Towne neighborhood.  After the stop, Fink smelled of alcohol and admitted she had been drinking but passed a field sobriety test, which did not require a breath test, a report states. </p>
<p>Windermere supervisor, Cpl. Carl Head, informed Winter Springs police that she had been pounding on the door of another Windermere officer&#8217;s home. Head said she appeared to be intoxicated and was driving a patrol car, a report stated.  Fink also explained why she had been pounding on a fellow Windermere officer&#8217;s door: He was her boyfriend and they had been arguing, the report states.  </p>
<p>&#8220;During my conversation with Fink she stated that she turned into the area because she was afraid that a police officer was behind her and she knew she had been drinking,&#8221; the report states. &#8220;I asked Ms. Fink how much she had to drink and she replied, &#8216;I had three beers and I know I should not have been driving.&#8217;&#8221;  Fink told Winter Springs police officers that &#8220;she would do anything if we would let her go. Ms. Fink reported that she could lose her [law-enforcement] certification for this.&#8221; </p>
<p>Windermere Police Chief Dan Saylor said Fink, 33, had been suspended pending the outcome of an administrative investigation. Officially, you don&#8217;t drink and drive,&#8221; said Saylor, referring to statewide policies for police and municipal agencies which prohibit public employees from driving a publicly owned vehicle after consuming any amount of alcohol. &#8220;No matter if it was one hour ago or 10 hours ago.&#8221;</p>
<p>By the time Windermere supervisors reached the scene, Fink had passed a field sobriety test.  Head told police, &#8220;I can&#8217;t believe she passed the exercises, she had been drinking since 9 o&#8217;clock last night,&#8221; the report states.</p>

<p>According to the police report, our client was driving his vehicle recklessly, failing to maintain a single lane and entering a intersection at a red light causing oncoming cars to swerve to keep from hitting our client&#8217;s car.   Our client was facing a lifetime driver license revocation if convicted along with mandatory jail.  Prior to trial, our office filed pre trial motions and conducted depositions.  During the depositions, plea negotiations were conducted with the State Attorney.  We were able to present several mitigating factors to the State including independent counseling.   We were able to resolve our client&#8217;s case at the trial date with a dismissal of the Felony DUI and a  plea to the lesser included misdemeanor reckless  driving.  As a result, our client was not sentenced to jail/prison and avoided the DUI lifetime driver license revocation.</p>

			<content:encoded><![CDATA[<p>While the facts of this case are from a different state, the DUI laws in Florida allow for a DUI arrest and subsequent conviction under similar facts&#8230;..  A 49 year old man in Illinois has been arrested and charged with a DUI and he wasn’t even driving his car. His license had been revoked due to a prior DUI conviction and he decided that rather than take public transportation, ask a friend for a ride or walk, he would take his riding mower to the nearest gas station for some beer. To make matters worse, the man was riding his mower on a public road while drunk.</p>
<p>Police were notified by witnesses that the man was weaving in and out of traffic on the riding mower. Police tried to stop the man, but he drove into his front yard reportedly spilling Milwaukee’s Best along the way. He is now facing a second DUI charge and bonded out on $10,000.</p>

			<content:encoded><![CDATA[<p>According to several Florida news agencies, all criminal charges stemming from a DUI arrest of a 23-year-old woman, Alexandra Torrensvilas, in Broward County, Florida have been dropped due to police misconduct.</p>
<p>The alleged police misconduct occurred after Hollywood Officer Joel Francisco rear-ended her car which was driven by Ms. Torrensvilas.    During the arrest of the young woman, the officer’s in car video camera recorded the unsuspecting officer stating, &#8220;Well, I don&#8217;t lie and make things up ever, because it&#8217;s wrong, but if I need to bend it a little bit to protect a cop I&#8217;m gonna,&#8221; an officer says to Community Service Officer Karim Thomas.</p>
<p>The investigation of the officer’s conduct resulted in State attorney spokesman Ron Ishoy issuing a statement stating prosecutors dropped charges against Torrensvilas because the video &#8220;could raise questions about the police account of the traffic mishap.&#8221;</p>
