Domestic Violence Battery Charges Dropped Against Mayor’s Wife

The Pinellas County State Attorney’s Office chose to drop the misdemeanor domestic battery charge against New Port Richey Mayor Scott McPherson’s wife, Kimberly McPherson who was arrested at Grille 54 in the early hours of July 26 on a simple domestic battery charge.  McPherson was accused of slapping her husband during an exchange between the two and a Pasco County deputy. Scott McPherson said during a City Council meeting Tuesday that the Pasco County Sheriff’s Office has opened a Professional Standards investigation of the arresting deputy.

Results from the sheriff’s office investigation are pending, and McPherson said he will reserve further comment until those deliberations have concluded.

Wife Tries to Run Over Husband During Domestic Violence

Police arrested Tracey McLaughlin on charges of aggravated assault with a deadly weapon without intent to kill and aggravated battery with a deadly weapon earlier today.  McLaughlin, 33 or Deland, is accused of attempting to run ehr husband over with her vehicle after a custody fight pertaining to their dog.  McLaughlin and her husband, Mark McLaughlin, 45, confronted each other about the dog Wednesday at 6:45 p.m. in front of their Palmetto Avenue home near DeLand, a sheriff’s incident report shows.

According to the report, Mark McLaughlin said their marriage is ending and he found Tracey McLaughlin at the home loading up her vehicle with personal possessions. Mark McLaughlin then saw his dog being taken and stood in front of the vehicle and questioned his wife.

During the heated argument, Tracey McLaughlin drove the vehicle toward her husband and hit him. She drove by three or four houses until her husband could “extricate himself from the vehicle,” the report states. Mark McLaughlin suffered a cut to his knee and refused medical attention, deputies said.

Tracey McLaughlin drove to her parents’ Deltona home where a deputy found her. She denied running over her husband, the report states.

Warren Sapp Arrested on Domestic Violence Charge

Former Tampa Bay Buccaneer turned “Inside The NFL” analyst Warren Sapp was arrested Saturday, February 6, 2010 on the allegation of battery domestic violence in Miami, Florida.  Sapp, who was in Miami covering Super Bowl XLIV for the NFL network, was suspended by the network pending a complete investigation. 

Sapp is also known from his appearance in the seventh season of “Dancing with the Stars” with professional dance partner Kym Johnson.  Sapp and Johnson ultimately finished second in the competition. 

The arrest occurred as a result of allegations made by his girlfriend of two years who was allegedly staying overnight with Sapp in his hotel room in Miami.  According to the alleged victim, Warren Sapp came into her room early in the morning and dragged her out of bed, starting an argument about some guys she had been hanging around earlier the previous evening. He then “grabbed her and began to choke her” and threw her out of the room, she claims.  

Sapp tells a different story. He told  Miami iBeach Police that he had originally allowed the alleged victim to stay in his room but had changed his mind. He said that he was “expecting company” and wanted her to leave. He said that he was trying to help her do just that and she fell.  Sapp was released Sunday morning (Feb. 7) on a $1500 bond.

Seminole County Domestic Violence Dismissed

The TILDEN LAW firm was recently hired to represent a repeat client accused in Seminole County, Florida of Battery Domestic Violence against his former girlfriend.   The alleged victim called 911 after she and our client became involved a verbal argument.  When law enforcement arrived, the victim filed a sworn written report that she was struck by our client resulting in raised red marks on her neck and arm. 

During the initial meeting and interview of our client, attorney N. Fleetwood Tilden determined that it may be possible to achieve a case dismissal by negotiating a “pre-filing” disposition.  Mr. Tilden contacted the State Attorney’s office and convinced the prosecutor to dismiss the criminal case once our client provided proof of completion of an anger management class within 30 days.  We complied within the time given which resulted in a dismissal of all charges.

Orlando Domestic Violence Injunction Dismissed

Tilden Law was recently hired to defend a client in a Domestic Violence Injunction hearing in Orange County, Florida.  Domestic Temporary Restraining Orders “TRO” are commonly sought by individuals who are in fear of repeat or future violence from another and there is a domestic relationship between the parties either by marriage, blood or shared residence.

Our client a resident of New York, was served with a restraining order from Orange County Circuit Court as a result of allegations of violence and threats made by his daughter, an Orlando resident.  Contained in the court file were 67 pages of documents and affidavits in support of the petitioner’s position and request for the temporary injunction to be made permanent. 

During the cross examination of the petitioner at the hearing, Mr. Tilden showed that there were no credible threats to support her allegations. As a result of our efforts, the judge entered a order dismissing the injunction at the conclusion of the hearing.
