<p>Our office is contacted numerous times per week regarding questions relating to domestic violence charges and defenses.  In late 2011, an individual was charged in Central Florida with domestic violence against his girlfriend while on vacation at a local theme park.  The allegations included both the victim and client consumed a large amount of alcohol and got into a argument.  Police were called to the scene and the vehicle driven by the defendant was stopped.  Injuries were observed on the victim including a black eye and numerous abrasions on her body.  The accused was later arrested and charged with criminal domestic violence battery.  It was determined that the victim did not want to press charges, however, the State Attorney decided to prosecute the case regardless of victim cooperation.  A declination of prosecution was prepared after the victim was interviewed and subsequently filed with the Clerk of Court and State Attorney&#8217;s office.  Negotiations with the State Attorney continued throughout the case which was set for trial.  Ultimately, the State Attorney agreed to dismiss the criminal domestic violence charges thereby allowing the client to petition for all criminal records to be expunged.</p>

			<content:encoded><![CDATA[<p>The 21-year-old son of a Sanford police officer is accused of attacking a homeless man in front of a Sanford bar.  A warrant for the arrest of Justin Collison has been issued alleging a charge of aggravated battery, a 3<sup>rd</sup> degree felony.  As a result of the attack, it is reported that the victim, Sherman Ware, suffered a broken nose.  Collison is the son of Lt. Chris Collison who is assigned to the Sanford police department’s patrol division. </p>
<p>The attack was recorded on video by a person outside the Wet Spot bar on Park Avenue in downtown Sanford.  Collison was questioned at the scene but not arrested.  Acting Sanford police chief Capt. Jerry Hargrett said Wednesday that officers made &#8220;blatant&#8221; policy violations that night, including not handcuffing Collison or patting him down.  Hargrett said he wasn&#8217;t sure why the officers didn&#8217;t arrest Collison, but said there was no evidence Collison was given preferential treatment.  The police department launched an internal investigation into four officers, including a sergeant, who were associated with the case.</p>
<p>The video shows Ware trying to break up a fight on the sidewalk when Collison walks up behind him and punches Ware in the back of the head.  Ware pitched forward, hit his head on a nearby light pole and fell to the ground. He was taken to Central Florida Regional Hospital with a broken nose.  A few days after the fight, police asked the State Attorney&#8217;s Office in Sanford to review the case and decide whether to file an aggravated battery charge against Collison.</p>

			<content:encoded><![CDATA[<p>Pittsburgh’s new head football coach has been arrested on allegations of Domestic Violence according to news reporting agencies.  Michael Haywood, who was named new head coach for the Pittsburgh Panthers football program is a former Notre Dame offensive coordinator and formerly played running back.</p>
<p>Haywood was arrested at the alleged victim’s residence Friday afternoon.  According to reports, a physical altercation erupted over a child custody issue as the alleged victim attempted to leave.  The victim reported that Haywood grabbed her arm and neck and also pushed her leaving marks on her neck, arms and back.</p>
<p>Haywood, who was hired by Pittsburgh on December 16<sup>th</sup> to replace football coach Dave Wannstedt remains in custody without bond due to the charges with an initial court date in January.</p>

			<content:encoded><![CDATA[<p>An Orlando police officer accused of grabbing a woman&#8217;s lactating <a title="Breast" href="http://www.orlandosentinel.com/topic/health/human-body/breast-HHA00009.topic"><strong>breast</strong></a> while working off duty resigned today.</p>
<p>Loverde, 31, is accused of grabbing the new mother&#8217;s breast after he walked her to her car at Firestone Live, a concert venue on North Orange Avenue downtown.   He is charged with battery, a first degree Misdemeanor  and false imprisonment, a second degree Felony. He was suspended without pay from the department on Dec. 17.</p>
<p>Loverde is currently out on bond in the amount of $5,500 with the additional condition of having no contact with the alleged victim.  Trial is currently scheduled for June 21, 2010.</p>

			<content:encoded><![CDATA[<p>Pittsburgh Steelers wide receiver and former Super Bowl MVP, Santonio Holmes, is facing a civil law suit from a University of Central Florida student suit based on allegations of the star wide receiver throwing a glass at the student’s face at a Orlando area nightclub in March of this year.  Anshonae Mills, 21, is seeking more than $15,000 in damages for battery, assault and intentional infliction of emotional distress from the March 7 incident at Rain Nightclub.</p>
<p>Mills filed her civil law suit in Orange County Circuit civil court alleging that Holmes was intoxicated and quarrelsome offered at the J. J. Whispers nightclub and further offered to pay her to keep quiet about the incident and not press charges. </p>
<p>According to the civil suit, Mills was sitting on the arm of a couch in the VIP section while speaking with her friend, when Holmes approached her and told her to &#8220;get up.&#8221; When she refused to move, Holmes started &#8220;yelling and waving his arms&#8221; in front of Mills. She grabbed his hand to prevent him from hitting her. Holmes yanked his hand away and the two began arguing. Other patrons at the club who saw the spat intervened to keep Holmes from grabbing Mills, the suit states. While the two were separated, Holmes threw his drink, glass cup included, at Mills&#8217; face. She was hit on the right side of her face and cut near her eye.</p>
<p>Mills said she felt pressure from Holmes and Orlando police officers and gave a short, incoherent witness statement and said she did not intent to press charges.  An incident report by Orlando police was not completed or available for public inspection Monday, more than 21 days after the attack.</p>
<p>This is the second time in a month that a Steelers player is accused of attacking a woman. Earlier this month, Pittsburgh quarterback Ben Roethlisberger was accused of assaulting a college student in Georgia. Roethlisberger has not been charged.</p>
<p>Public records show Mills has two prior arrests including an arrested in June on a domestic violence charge, which accused her of pushing her boyfriend into a wall at Pegasus Landing apartments. She was jailed, but the charges were later dropped, records show.</p>

<p>An Orange County deputy sheriff was before an Orange County Circuit court judge on Tuesday after an allegation of domestic violence.  Bryan Villella, a 25 year member of the sheriff’s office appeared before Orange Circuit Judge Sally D.M. Kest after an injunction for protection against domestic violence was petitioned for by the deputy’s ex-boyfriend. </p>
<p>In her ruling after the injunction hearing, Judge Kest also prohibited the deputy from contacting his ex-boyfriend in a hostile manner as well as prohibiting the deputy from carrying a weapon during non-working hours.</p>
<p>Although Villella&#8217;s attorney, Tim Berry, asked Kest if his client could be allowed to carry his weapon during off-duty security assignments, she said the court &#8220;will not be making any special exceptions in this case.&#8221;</p>
<p>Deputy Villella’s alleged boyfriend, Angel Joel Carrion on Feb. 18 filed a petition for a domestic-violence injunction for protection. But Kest instead granted a less restrictive &#8220;no-hostile contact injunction,&#8221; which means Villella can contact Carrion and show up at his house or place of business, but not act in a hostile way.</p>
<p>Carol Wick, chief executive officer of Harbor House, Orange County&#8217;s only shelter for victims of domestic abuse, said the order is limited and doesn&#8217;t offer the same protections as a order for protection against domestic violence.</p>
<p>&#8220;Domestic violence isn&#8217;t about hostility. It&#8217;s about power, control and fear,&#8221; Wick said. &#8220;However, I have a good deal of faith in the Sheriff&#8217;s Office. I know Sheriff Jerry Demings will not tolerate anything happening.&#8221;</p>
<p>Carrion in 2009 had complained to Sheriff&#8217;s Office investigators that Villella repeatedly beat him during their four-year relationship.  The Sheriff&#8217;s Office launched an investigation into Villella after Carrion accused the deputy of making him clean up his own blood after one incident, court documents show. The investigation is pending.  Villella, a 25-year veteran of the Sheriff&#8217;s Office whose current yearly salary is $56,908, has faced previous allegations of domestic violence.</p>
<p>The first allegation of domestic abuse came to light in 2001. His ex-wife, Helen Mackenzie, served him with a temporary domestic-violence injunction, alleging physical abuse during their five-year marriage.  Sheriff&#8217;s Office investigators could not confirm her accusations, but said &#8220;it is clear Villella and Ms. Mackenzie have a history of domestic disturbances.&#8221;</p>
<p>Villella&#8217;s most recent discipline came in October when Sheriff&#8217;s officials docked 150 hours from Villella&#8217;s pay and placed him on one year of disciplinary probation for having sex with a male guest in a Royal Plaza Resort conference room while working off-duty security during Gay Days.</p>

			<content:encoded><![CDATA[<p>Former Orange County Florida deputy sheriff, Belinda Mills, was arrested on suspission of burglary and battery domestic violence earlier today.  According to police reports, Karen Cerezo and Belinda Mills broke into the home of  the alleged victim, Richard Cerezo, who is reported to be the ex husband of Karen Cerezo.  Upon gaining entry to the residence, both Mills and Cerezo began beating her ex husband until 911 was called.  According to the 911 caller, the two women appeared drunk.  After taking statements from all parties in the residence at the time of the event, police decided to arrest both women.</p>
<p>In September 2009,  Mills called authorities to report an attempted rape claiming a man was in her apartment when she arrived home. She fired two shots from her agency weapon in the incident, setting off a massive manhunt. The case is not active because there were no leads. It&#8217;s not known if she filed a false report.</p>

			<content:encoded><![CDATA[<p>Former Tampa Bay Buccaneer turned “Inside The NFL” analyst Warren Sapp was arrested Saturday, February 6, 2010 on the allegation of battery domestic violence in Miami, Florida.  Sapp, who was in Miami covering Super Bowl XLIV for the NFL network, was suspended by the network pending a complete investigation. </p>
<p>Sapp is also known from his appearance in the seventh season of “Dancing with the Stars” with professional dance partner Kym Johnson.  Sapp and Johnson ultimately finished second in the competition. </p>
<p>The arrest occurred as a result of allegations made by his girlfriend of two years who was allegedly staying overnight with Sapp in his hotel room in Miami.  According to the alleged victim, Warren Sapp came into her room early in the morning and dragged her out of bed, starting an argument about some guys she had been hanging around earlier the previous evening. He then &#8220;grabbed her and began to choke her&#8221; and threw her out of the room, she claims.  </p>
<p>Sapp tells a different story. He told  Miami <span style="text-decoration: underline;">i</span>Beach Police that he had originally allowed the alleged victim to stay in his room but had changed his mind. He said that he was &#8220;expecting company&#8221; and wanted her to leave. He said that he was trying to help her do just that and she fell.  Sapp was released Sunday morning (Feb. 7) on a $1500 bond.</p>

			<content:encoded><![CDATA[<p><span style="color: #ff0000;"><span style="text-decoration: underline;"><strong>Felony Domestic Violence Charge Dismissed</strong></span><span style="color: #000000;"><strong> </strong></span></span></p>
<p><span style="color: #ff0000;"><span style="color: #000000;"><strong>TILDEN LAW</strong> was contacted by a client recently who was facing a charge of Felony Domestic Violence Battery by Strangulation and Witness Tampering in Seminole County, Florida.  According to the police affidavit, our client was involved in an argument with his wife relating to a variety of domestic issues.  As the argument escalated, the report indicated that our client grabbed his wife by the throat with his hands and attempted to strangle her until she almost lost consciousness.   The report further indicated that the alleged victim attempted to use her cell phone to call 911 but it was taken from her by our client in an attempt to prevent her from calling police.  </span></span></p>
<p><span style="color: #ff0000;"><span style="color: #000000;">Our office became involved shortly after our client was arrested and while he was being held in jail without bond.  Attorney <strong>N. Fleetwood Tilden, </strong>immediately filed a motion for bond with the court.  D</span></span><span style="color: #ff0000;"><span style="color: #000000;">uring the hearing, the court granted our motion as well as our further request that our client be released without special condition of no victim contact and no return to the shared residence.  As the case progressed, Mr. Tilden was able to negotiate a resolution where the State Attorney dismissed the both Felony charges.  Our client ultimately resolved his case with a non-conviction to a misdemeanor charge.   </span></span></p>
