Orange County Theft: Orlando Wal-Mart Shoplifting Charge Dismissed

A recent TILDEN LAW client was charged with Shoplifting and Petit Theft at an Orlando, Florida area Wal-Mart store, under Fla. Statute 812.014. Our client and her husband were checking out at a self check isle and were stopped by Wal-Mart loss prevention officers as they were leaving the store. Wal-Mart accused our clients of scanning only part of the items in their cart and attempting to leave the store without paying for the balance of their merchandise.

Attorney N. Fleetwood Tilden filed several pre-trial motions to inspect evidence including the in-store video surveillance camera footage. Mr. Tilden also interviewed Wal-Mart store employees and security staff. Based on the information and evidence Mr. Tilden was able to acquire, he was successful in convincing the State Attorney’s Office to dismiss the criminal case against our client.

Seminole County DUI Attorney

Orlando Criminal Records Expunged

TILDEN LAW offers its clients the ability to erase a prior Florida criminal charge via the expungement and sealing process.   Not long ago, we were contacted by a former client who our firm represented on a criminal charge what we were successful in getting dismissed.  The charge that was dismissed was domestic violence and occurred in Orange County, Florida.  It was critical to our client that he achieves an expunction of his criminal record because he was engaged in government contract work and was required to complete and pass a background check before being awarded work and being allowed on the government facility.     

Attorney, N. Fleetwood Tilden, prepared the Florida Department of Law Enforcement expungement application and accompanying documentation and made the filing.  Because of the nature of the charge, the State Attorney’s office required a hearing before a judge to determine whether our client was eligible.     During this hearing, Mr. Tilden was able to convince both the State Attorney and Judge that our client was entitled to have his criminal record expunged, and the motion was granted.

Seminole County DUI Dismissed

TILDEN LAW is a Central Florida criminal defense firm that specializes in successfully defending clients charged with DUI in both Orange County and Seminole County courts.  We were fortunate enough to recently represent a client who had been arrested in Seminole County and accused of DUI.  Our client was initially stopped for failing to maintain her lane of travel.  The officer noted a smell of alcohol from our client’s breath and two passengers inside the vehicle who appeared intoxicated.   Our client agreed to participate in Field Sobriety Tests at the roadside which indicated impairment according to the officer’s report.  Our client was arrested and taken to the Seminole County Jail where she refused the breath test. 

As a result of his training and experience, Attorney, N. Fleetwood Tilden, recognized several potential issues relating to both the vehicle stop and arrest of our client.  Mr. Tilden filed several pre-trial motions based on these legal issues and began extensive negotiations with the Office of the State Attorney.  As a result, the prosecutor agreed to dismiss the pending DUI charge and re-file as a lesser charge.

Orlando Drug Charge Dropped

TILDEN LAW was recently successful in defending a client charged with a drug offense which resulted in all criminal charges being dropped.   According to the Orange County Sheriff’s Department arrest report, our client was initially stopped for throwing a lighted cigarette out of his window while driving his vehicle on Colonial Drive in Orlando, Florida.  After being advised the reason for the stop, the Deputy requested permission to search our client’s vehicle which he refused.

A K-9 unit was called to the scene of the stop to conduct a canine search from the vehicle’s exterior.  According to the report, the K-9 units sweep search of the vehicle resulted in a “hit” or positive indication of drugs.  A search of the interior of the vehicle revealed a bag of Marijuana and two marijuana smoking pipes in the center console. 

Immediately after being retained by our client, attorney N. Fleetwood Tilden, filed pleadings entering a plea of not guilty as to all charges and requested copies of all drug tests conducted.  Mr. Tilden also petitioned the State Attorney’s office to dismiss all charges against his client.  As a result, the Orange County State Attorney’s office agreed with our request, dismissing all charges against our client.

Central Florida Drug Ring Busted

A Debary, Florida man has been accused of running a prescription drug ring employing as many as 30 people.  According to the Volusia County Sheriff’s office, John Davey was arrested and held in jail on a $1 Million bond.  Investigators believe Davey forged pprescriptions for Xenix, an anti-anxiety and pain killer drug.  People in Davey’s employ would then take the forged prescription to a local pharmacy to get the prescription filled and then pay the employees in either cash or drugs.

According to Deputies, Davey had prescriptions for more than 14,000 pills with an estimated street value of $200,000.  Davey was arrested after investigators with the Sheriff’s office followed him and two of his employees to a pharmacy where they allegedly obtained a filled pprescription for oxycodone.

Orlando DUI License Suspension Overturned

A few weeks ago, Tilden Law was contacted by a client who had been arrested in Orlando on a DUI charge that resulted in her driver license being suspended for refusing to take the breath test.  According to the police report, our client was accused of weaving within her own lane of travel and with having a tail light out.  Once stopped by police, the officer noted a smell of alcohol and requested she participate in Field Sobriety Exercises.  As a result of her performance, the officer arrested and charged our client with DUI.  At the breath testing facility, our client refused to provide a breath sample after being read implied consent.  The result of her refusal was a one (1) year driver license suspension. 

Attorney, N. Fleetwood Tilden, filed for a Formal Review Hearing on behalf of our client to challenge the suspension of her license.  At the hearing, Mr. Tilden cross examined the arresting officer and determined that several errors were made in both the preparation and filing of the documents by the officer.  Mr. Tilden motioned the hearing officer to invalidate the suspension of our client’s driver license which was granted.  As a result, our client now has her full driver license reinstated without cost or penalty.

Florida Porn Star’s Domestic Violence Charge Dropped

A domestic battery case against porn star and aspiring U.S. Senate candidate Stormy Daniels was dropped after the alleged victim, her husband, decided not to prosecute. The State Attorney’s Office said, Daniels, whose real name is Stephanie Gregory Clifford, was arrested in July after her husband told Tampa police that she hit him several times during a dispute about laundry and unpaid bills. Pam Bondi, a prosecution spokeswoman in Hillsborough County, said prosecutors could not determine who the aggressor was. There were no visible injuries. “He did not want to prosecute,” Bondi said.

Orlando area Drug Bust Nets 8 Pounds of Ecstasy

Central Florida’s largest Ecstasy bust in recent years resulted in seizure of eight pounds of the drug according to the federal Drug Enforcement Agency.

Claude Amir and Yair Harrosch, both Canadian nationals, were arrested at the Cascade Apartments in Daytona Beach Shores, where he drug was being packed into capsules for consumption. Known by many street names Methylenedioxymethamphetamine (MDMA) has been a popular illegal drug since the rave parties of the 1990’s. Priced at up to $30 a capsule, the drug induces euphoria and mild hallucinations.

Amar, 37, and Harrosch, 27, made their first appearances in federal court in Orlando on Tuesday, September 1, 2009. Each faces a charge of possession with the intent to distribute MDMA. Both men were appointed public defenders.

According to a criminal complaint signed by a DEA task force agent, a confidential informant had been talking to Amar in recent weeks about the prospect of Amar selling him MDMA. On Monday, the informant and Amar met at a Daytona Beach restaurant, and Amar told the informant he bought four kilograms of pure MDMA for $100,000, and spent $3,000 to transport the drug from Canada. Amar told the informant he would sell the pure MDMA to him for $40,000 per kilogram. After lunch, the informant and Amar went to Amar’s home at the Cascade Apartments. That’s where the informant saw Harrosch weighing MDMA and packing the drug.

The informant bought $2,500.00 worth of MDMA from Amar. Amar told the informant the MDMA was enough to manufacture 500 pills. Soon after, Amar and Harrosch were arrested.
