Orlando Domestic Violence Injunction Dismissed

Tilden Law was recently hired to defend a client in a Domestic Violence Injunction hearing in Orange County, Florida.  Domestic Temporary Restraining Orders “TRO” are commonly sought by individuals who are in fear of repeat or future violence from another and there is a domestic relationship between the parties either by marriage, blood or shared residence.

Our client a resident of New York, was served with a restraining order from Orange County Circuit Court as a result of allegations of violence and threats made by his daughter, an Orlando resident.  Contained in the court file were 67 pages of documents and affidavits in support of the petitioner’s position and request for the temporary injunction to be made permanent. 

During the cross examination of the petitioner at the hearing, Mr. Tilden showed that there were no credible threats to support her allegations. As a result of our efforts, the judge entered a order dismissing the injunction at the conclusion of the hearing.

Orlando Theft Charge Dropped

While shopping with her infant child recently at an Orlando area department store, a young mother was stopped and accused of shoplifting items by the store’s loss prevention officer.  Specifically, store employees identified our client as placing store merchandise into her baby stroller and not paying for the items.  Police were called and responded to the scene and a sworn affidavit was filed with the Orange County State Attorney’s office claiming criminal theft. 

Attorney N. Fleetwood Tilden of Tilden Law handled the case to a successful conclusion.  Upon reviewing the allegations and supporting documents provided by our client, Mr. Tilden contacted the Orange County State Attorney’s office and provided detailed information and defenses to the charges.

Nude Motorcyclist arrested for DUI

Captain Mike Rolls of the Marion County Sheriff’s department couldn’t believe his eyes in the early morning hours of September 15, 2009.  Rolls was on patrol traveling eastbound on State Road 200 near Interstate 75 when he saw the strange sight driving westbound toward the interstate’s northbound on-ramp.  A motorcyclist who just passed him wasn’t wearing any clothes.

The driver, Dante J. Krauss, 45, of Dunnellon, whose arrest record includes four prior DUI convictions and a 10 year driver license revocation, bonded out of the Marion County Jail later the same day.  According to the arrest report, Krauss admitted to drinking and stated that the last thing he remembered was going to Hooters.

Krauss was given a shirt, courtesy of a nearby hotel, and his lower body was covered with a shawl that had been on the handlebars of the motorcycle.

A field sobriety exercise was performed, and Krauss reportedly failed, at which time he was taken to the Marion County Jail. During a breath test, he reportedly registered a blood-alcohol content of 0.178 and 0.162. The state’s legal limit is 0.08.

Police arrest drivers leaving court

Thirteen people whose drivers license were suspended or revoked were arrested after they drove away fromcourt in Delray Beach, Florida.  Florida Highway Patrol troopers stopped the thirteen individuals shortly after they left the parking lot of the courthouse knowing that each had lost their driving privileges. 

Undercover officers in plain cloths attended the court session in which a judge had suspended these indivisuals drivers licenses and warned each of them not to drive until their driver license had been reinstated.   After observing the violators drive off, uniformed troopers were notified and the individuals stopped and arrested.

The crackdown is part of a statewide sting operation by the Florida Highway Patrol targeting those who drive to and from court proceedings despite having their drivers license suspended.

Undercover sting nets Craigslist prostitution arrests

With a few clicks of the computer mouse, he pulled up a page for a local woman advertising her services as an escort. Translation: sex for money.  It’s the modern version of the world’s oldest profession. Women who trade sex for money have found their way to solicit clients, on the information superhighway and specifically Craigslist.

On Wednesday, online escorts were center stage for Central Florida’s Metropolitan Bureau of Investigation agents who worked a sting operation aimed at escorts who charge upward of $200 an hour for their services.  As the crackdown continued into the night, five women ages 20-30 were arrested on allegations of prostitution.

MBI was the latest Central Florida law-enforcement endeavor to target prostitutes who market themselves online. A similar sting operation in Polk County led to 34 arrests last weekend. Those suspects included prostitutes and pimps, Polk officials said.

Agent Riggi is a 19-year law-enforcement veteran and supervisor of MBI’s Vice and Organized Crime unit. His years on the job have taught him how to spot a likely prostitution advertisement.  He clicked on an ad called “!Sweet as Candy!” posted in the casual-encounters portion of Craigslist. He finds a few short sentences and a picture of a scantily clad woman.  The posting, which may look distasteful to many people unaware of the subculture of escorts, pimps and prostitutes, doesn’t immediately appear illegal.  “Wanna play today? Come on over!” the listing says.  But it’s the next sentence that catches Riggi’s eye.  *$erious Gentlemen Only Plea$e*”  Although there is no mention of money, the dollar signs used in the last line shows Riggi this isn’t just a girl looking for fun. She’s likely a high-dollar escort, so he logs into his undercover e-mail account and fires off a message.  He wants to get her to an Orlando hotel where a pre-arranged bust is already scheduled. But she does not reply.

Central Florida MBI has been looking for prostitutes on the Internet for at least five years, scanning ads in such online sites as Craigslist and backpage.com. The agency schedules several stings per year but will do them spontaneously if hotels or other businesses complain.  MBI also monitors massage parlors, some of which advertise on the Internet. But it leaves the streetwalkers who frequent high-traffic areas such as to local law enforcement.

Violent drug gang laundered money through hot-dog stand

Although locals claimed the hot dogs were lousy and the customers were few, Hot Dog City was making millions of dollars. The financial success had nothing to do with the food: The business was allegedly a front for a cocaine-and-marijuana operation run by a homegrown gang gone big time, drug agents said.

Newly released documents paint a picture of a violent group that hid in plain sight on the main drag of this historic city, down the street from the police station. At night, they went home to a quiet, working-class neighborhood nearby. Soon, people realized something was wrong.

Cars came and went at all hours at the homes of Daniel Perez, 27, accused of leading the Westside gang, and his brother David Perez, 25. The brothers disappeared for days at a time. Nobody seemed to work. “You don’t have brand-new vehicles in your yard and not have a job,” said one neighbor, who requested anonymity for fear of reprisals.

In May, drug agents raided five homes and businesses, confiscating cars, guns and cash. Sixteen people were arrested. Most remain jailed. Two more are on the run. Most are charged with conspiracy to traffic cocaine. Daniel Perez could be sentenced to life in prison if convicted of directing the activities of a criminal gang. He also is charged with racketeering, conspiracy to traffic cocaine and money laundering.

Members operated the hot-dog shop and a secretarial service elsewhere in Winter Garden, arrest papers show. Although they didn’t do much business, the hot dogs in particular were unpopular, neighboring shopkeepers said, a steady flow of money was deposited into corporate accounts. Investigators said it came from drug profits. “It gives it the appearance of legitimacy,” said the lead case agent, Brent Harrison of the Florida Department of Law Enforcement.

The arrests stemmed from a painstaking 11-month investigation that involved intercepted cell-phone conversations among gang members, surveillance, bank records and the use of informants.

Father charged with selling cocaine to undercover agents

A man, whose daughter was killed by his pet python in July, was arrested on Friday and charged with selling cocaine in Oxford, Florida.

Police said Charles Darnell, 32, sold the drug to undercover Sumter County agents.

The arrest was a result of a one-week operation where agents allegedly made two separate buys from Darnell at his home in Oxford. On both occasions, undercover agents purchased powdered cocaine. 

The transactions occurred at the front yard of Darnell’s residence. The Special Investigations Squad conducted a field test on the purchased product, which came back positive for cocaine. 

Darnell was charged with two counts of sale of cocaine, two counts of possession of cocaine with intent to sell, two counts of unlawful use of a two-way communication device and two counts of keep shop for dangerous drugs. His bond has been set at $110,000. 

Shaiunna Hare, 2, was killed in July in Sumter County when her family’s 8-foot python got out of its enclosure and strangled the child. Officials are investigating whether the snake’s cage met the proper requirements. Police said Darnell, the owner of the snake, also did not have the required permit for the snake.

Chris Brown Receives Probation for Domestic Violence

A judge sentenced Chris Brown to five years probation and six months community labor for the beating of Rihanna an issued a stern admonition to the singer.

Los Angeles Superior Court Judge Patricia Schnegg told brown he could be sent to state prison if he violated any term of his sentence, including an order to stay away from the pop star for the next five years.

Brown will serve his sentence in his home state of Virginia. The judge says she wanted to ensure that Brown, 20, performs physical labor instead of community service, such as mentoring young people. A felony charge of making criminal threats was dropped. Rihanna did not attend the sentencing.

Florida Thief Returns For Leftovers

A burglar who made off with a Pensacola man’s valuables returned to the home later to take what he couldn’t carry on his first trip: a 100 pound plasma screen TV. A police was on the scene investigating the first burglary when the thief made off with the TV. The man who lived at the house said that the suspect had already stolen his wallet, watch and video game system. Investigators had left the TV in the backyard, where the burglar put it to dust for fingerprints. Police have offered to pay for the TV.

Florida Fugitives Caught with Bait

Cops in Fort Lauderdale took advantage of the not so clever criminals in the State by mailing letters to them informing them they were receiving stimulus checks. The suspects were asked to call a hotline and set up an appointment to pick up a check from an auditorium where “South Florida Stimulus Coalition” banners hung. When the fugitives arrived, they were identified and about 75 were arrested on offenses ranging from fraud to grand theft to attempted murder. Police spokesman Sgt. Frank Sousa said the two day sting was dubbed “Operation Show Me The Money.”
